Tax audit representation.
The IRS always initiates an audit notice by mail. In all but the most trivial of matters that you can handle yourself, e.g., minor errors in math calculations, missing documentation for small deductions, and clarifications on simple income sources, you should have a qualified tax attorney advise you about the audit, what to expect, and any concern about exposure of problems creating an "eggshell audit" situation or the possibility of a "reverse eggshell audit." Those two types of audits are always explained by Marc Thomas during the course of a consultation. It's important that any response to the IRS audit notice is prompt and accurate.
2. Installment agreements and partial pay installment agreements and common and handy remedies that can be a solid solution to tax debt trouble. An experienced tax attorney can make sure all the applicable benefits and features of these installment agreements are applied in your favor.
3. The Offer in Compromise is one of the only ways, in addition to the partial pay installment agreement or bankruptcy, to settle with the IRS, if not "for pennies on the dollar," then at least for a substantial discount. There are special circumstances that have to exist to be eligible for the IRS to consider the OIC. We can advise you about whether to pursue an OIC and if it should be part of your strategy to rid yourself of IRS debt.
4. Your defense against IRS or Department of Justice claims of civil or criminal tax fraud should never be handled without an experienced tax attorney with experience in these areas. Not only your assets, but your liberty is at stake and those claims need to be taken seriously.
5. The "next of kin" to claims of tax fraud are claims that you are a "responsible person" to see that employee wage withholding is properly and regularly paid to the government. If it's not, the IRS will audit your payroll and, if they find payroll taxes have not been paid, they will impose the Trust Fund Penalty Tax which, if the company cannot pay the arrearage that has accumulated, you will be personally liable. An IRS questionnaire, called IRS Form 4180 should never, every be filled out or signed by you without first consulting with a qualified tax attorney like Marc Thomas.
6. You may have been penalized unfairly or improperly and, in those cases, we can advise you and prepare a request to remove or "abate" any number of penalty, including failure to pay or failure to file. Many times penalties can be abated if the true circumstances that gave rise to the mistake, delay, or failure to perform a legal duty are properly explained to the IRS or the state of Michigan. We can do that for you and give yourself the best chance to remove any and all types of IRS or state penalties.
7. You may find that you will have to sue for a refund in federal court or defend your property transfers, gifts, or other actions that have resulted in assets being transferred out your control to a close family member, other relatives, or friends and, now, the IRS is challenging those transfers as an attempt to make yourself collection proof. In those cases, the actions are brought in a federal district court and you need competent, experienced attorneys like Marc Thomas to assist you in this regard. Similarly, there are many reasons for seeking relief in the United States Tax Court from substantive and procedural irregularities occurring with the IRS's decisions and processing of your case.
